Among Tony’s environmental practice experience is the victory, via summary judgment, in the Otay Land Company v. U.E. Ltd. case which was filed in the United States District Court for the Southern District. Tony’s client was sued for damages that were alleged to be in the range of $20,000,000. The client was a lessee of a trap and skeet range who was sued, more than twenty years later, for alleged contamination of the property.
He has also represented clients in matters involving the U.S. EPA, California EPA, the County of San Diego (Department of Environmental Health and other divisions as well), the City of San Diego, the Regional Water Quality Control Board and the F.A.A. He has been successful in locating decades-old insurance policies and then obtaining both a defense and indemnity for his clients through those insurance policies. Tony’s experience as a litigator has been of great help to his clients when facing opposing counsel knowledgeable in environmental matters but without similar exposure to trials and arbitration.
He has handled cases involving asbestos (both contamination and wrongful death matters), lead, dry cleaning solvents and petroleum products.
